Can we file a quit claim deed in FL for 2 weeks of TS. Pd for in full - flexible red weeks at Polynesian Isles in Kissimmee, FL? We have had them 20 years and no longer need them. help......

You can try -- there is no guarantee that the resort will accept it, but if you haven't tried it yet it is probabaly worthwhile - especially if it is a red week.

I would contact the resort and be up front about the fact that you are considering a quit
claim deed to rid yourself of the timeshares. Sometimes, a quit claim deed does not
rid you of the responsibility of paying the maintenance fees. You may find yourself
still on the hook for this in the years after you are no longer on title.

Can you explain how the timeshare can be quit claimed back to the timeshare company and yet the maintenance fees still go on? If that is true, how do you stop the maintenance fees?

And then what happened? If the quite claim didn't go over perhaps you could list them on the free board?

I do not believe you can quit claim deed a timeshare back to the resort
without their permission. The grantee has to be in agreement. However,
in most cases if the mortgage has been satisfied and there are no outstanding maintenance fees, etc., you can quit claim it to an individual who agrees to taking over the ownership. You have to take it one step further and notify the resort by providing them with a copy of the recorded quit claim deed so they can update their records. Some resorts charge a fee to update their records. Once the records are updated, you will no longer be on the hook for future maintenance fees. The grantee or new owner would be billed by the resort directly.

It is best to call the resort first and tell them of your intentions, as each resort has it's own policies on these matters. Some want to do the entire transfer themselves, for a fee.
