View Full Version : Can they really sue you?

Can a TS sue you for not paying? Does anyone here know anyone that this has happened to? It seems there are a lot of posts here, but they never seem to have a definitive answer/reply/ending of what actually hasppened, ie: they cancelled my contract, it went to foreclosure or I'm getting sued?

I know we are all looking for answers, but some follow-through is required so we can all learn from each other.

Yes, they can. Will they is another question. In most cases the cost of suing is too much to be cost effective for them so I don't think it is currently a common practice.

Could this happen if you are in a mortgage and walk away from it? Would the the bank and/or TS company come after you? As it was stated yes they could sue you over the contract and its contents but at what price? I'm still trying to find willing people to band together to after these TS people. Enough is enough! Who are the victims here?

A timeshare company (at least from Mexico) is not likely to file a lawsuit for lack of payment.

They can, however, and usually they do, send your account to a US or Canadian collection agency and they willl, for sure, affect your credit score.
